Terms of Service

These Terms of Service (the "Terms") are an agreement between you and ImageVideoAI ("we", "us" or "our"). They govern your use of the website at imagevideoai.app and everything offered on it (the "Service"). Please read them together with our Privacy Policy and our Refund Policy, which form part of these Terms.

Acceptance of these Terms

By accessing or using the Service, whether or not you sign in, you accept these Terms. If you do not accept them, do not use the Service. If you use the Service for a company or other organization, you confirm that you may accept these Terms on its behalf, and "you" then includes that organization.

Definitions

  • Account means the account you create by signing in with Google.
  • Inputs are the photos you upload and the text prompts you write.
  • Output is any video the Service generates from your Inputs. Inputs and Output together are Your Content.
  • Credits are the units that meter video generation. The number a video costs depends on the model, resolution and duration you choose and is shown before you generate.
  • Plan means a monthly or annual subscription. Credit Pack means a one-time purchase of credits.
  • Model Providers are the third parties whose AI video models power the Service, for example the providers of Kling, Veo, Seedance, Hailuo and Wan.

Eligibility

You must be at least 18 years old to use the Service, and by using it you confirm that you are. We may close any account that we reasonably believe belongs to someone younger.

The Service

ImageVideoAI turns a photo and a short description of the motion you want, or a text prompt alone, into a short AI video. You pick a model from the families we offer, currently Kling, Veo 3.1, Seedance, Hailuo (including MiniMax H3) and Wan 3.0, choose the settings that model supports, and download the result. The models are built and run by the Model Providers, not by us. We may add, update or retire models and versions as providers change them.

  • Guests: anyone can make one free video a day without an account. It uses Seedance 1.0 Pro Fast at 480p, lasts 5 seconds and carries a watermark.
  • Free accounts: signing in adds 30 one-time signup credits, valid for 30 days from the day the Account is created, and 5 free daily credits that renew on a rolling 24-hour basis and do not accumulate. Free accounts can use every model except Veo 3.1 Quality, at resolutions no higher than 720p, with one exception: Hailuo 2.3 and Hailuo 2.3 Fast, whose lowest setting is 768p, can be used at 768p. Their videos carry a watermark.
  • Paid use: while you have an active Plan, or a Credit Pack with credits left, your videos have no watermark, you can export at 1080p, 2K or 4K on models that offer those resolutions, you can run up to 3 generations at once, you may use the Output commercially, and your files are kept for 180 days.

Current prices, allowances and limits are shown on the pricing page and in the generator. We may change features and limits to keep the Service running well. If a change takes away something you have already paid for, it will not apply to you until your current billing period ends, or we will offer you a pro-rata refund.

Accounts

You need an Account to receive signup and daily credits and to buy a Plan or Credit Pack. You are responsible for activity on your Account and for keeping your Google account secure. Tell us at [email protected] if you think someone has used your Account without permission.

The free tiers are meant for one person. Do not open several accounts, clear your browser, switch devices or networks, or use scripts, proxies or other tricks to collect extra free videos or credits. We use automated checks to enforce this and may limit or close accounts that break this rule.

Credits, plans and payments

Credits

  • The credits a video will use are shown before you start it and are deducted when you submit the generation.
  • If a generation fails, its credits are returned automatically to the balances they came from, except any that expired while it was running.
  • Credits are spent in a fixed order: free daily credits first, then signup credits, then the current month's Plan credits, then Credit Pack credits, starting with the pack that expires soonest.
  • Signup credits expire 30 days after your Account is created, and any that remain unused at that point are removed. They are given once per device, and only to a limited number of new Accounts from the same IP address each day.
  • Free daily credits do not carry over: anything left unused when the next 24-hour allowance arrives is gone.
  • Plan credits are issued once per billing month, including on annual billing, and expire at the end of that month.
  • Credits from a Credit Pack stay valid for 12 months from the purchase date.
  • Credits have no cash value. They cannot be exchanged for money except as our Refund Policy describes, and they cannot be sold, transferred or moved to another account.

Plans

Plans are billed in advance, monthly or yearly, and renew automatically at the then-current price until you cancel. You can cancel at any time under Manage billing in your account menu, which opens Stripe's billing portal. Cancelling stops future renewals; your Plan stays active until the end of the period you have already paid for and then ends.

Credit Packs

Credit Packs are one-time purchases. They do not renew and there is nothing to cancel. The paid features listed above apply while you have unexpired Credit Pack credits left.

Payments and prices

Payments are processed by Stripe, and by buying you also agree to Stripe's terms for that payment. Prices are shown in US dollars and may include, or be subject to, taxes depending on where you live. We may change prices. A new price applies to a Plan from its first renewal after we have told you about it, and never to a period you have already paid for. If a payment fails or is reversed, we may pause paid features until it is settled. Please contact us before opening a chargeback so we can try to fix the problem.

Refunds

Credits spent on a failed generation come back without a request. Separately, any charge, whether a first Plan payment, a renewal or a Credit Pack, is fully refundable for 7 days after the charge if you have not used any of the credits it added. A refunded charge ends the Plan period or removes the Credit Pack it paid for. Cancelling a Plan does not by itself refund the current period. The full rules and how to ask are in our Refund Policy. Nothing in these Terms limits refund rights you have under consumer law.

Your content

You keep all rights you have in your Inputs. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process and display Your Content, and to send your Inputs to a Model Provider, only as needed to run the Service for you. That covers creating the Output, adding a watermark where one applies and showing you previews. The license ends when Your Content is deleted, except for copies we must keep by law.

We never use Your Content to train AI models. We do not claim ownership of your Output, and to the extent we hold any rights in it, we assign them to you. Output generated while you have an active Plan or Credit Pack credits may be used for commercial purposes. This right is decided when each video is generated and is permanent: it stays with that Output after your Plan ends or your Credit Pack runs out. Output from the free tiers is for personal, non-commercial use, and buying a Plan or Credit Pack later does not change that. Downloads on the free tiers carry a watermark; do not remove or hide it. AI models can produce similar results for different people, and in some countries AI-generated material may not be protected by copyright, so we cannot promise that your Output is unique or that you can stop others from using something similar.

By uploading a photo or writing a prompt, you confirm that:

  • you own the photo or have every permission needed to upload it and turn it into a video;
  • every identifiable person in it has agreed to appear in the video you are making, and has clearly agreed to any kiss, hug or other intimate effect; and
  • creating and using the Output does not break any law or anyone else's rights, including rights of privacy and publicity.

Acceptable use and prohibited content

Use the Service only for lawful purposes and in line with these Terms. You must not create, upload or share through the Service:

  • Content involving minors: any material that sexualizes, exploits or endangers a minor, and any romantic or intimate scene that includes a minor. Child sexual abuse material is reported to the National Center for Missing and Exploited Children (NCMEC) and other authorities.
  • Adult or sexual content: nudity, pornographic or sexually explicit material. The Service does not support adult content of any kind.
  • Intimate content without consent: kissing, hugging or other intimate videos made from photos of real people who have not clearly agreed to it.
  • Impersonation and deception: deepfakes or other Output made to impersonate a real person, to mislead people about real events, or to commit fraud or scams.
  • Violent or harmful content: graphic violence or gore, or material that promotes terrorism, self-harm or suicide.
  • Hate and harassment: material that promotes hatred of, harasses, bullies or threatens people or groups.
  • Infringing content: photos, characters or other works you do not have the right to use.
  • Illegal content: anything else that breaks the law where you live or where the Service operates.

You also must not:

  • access the Service through bots, scrapers or unofficial clients, or overload its infrastructure;
  • bypass watermarks, usage limits, security checks or payment;
  • probe, attack or reverse engineer the Service or the models behind it;
  • resell the Service or offer it to others as your own product without our written permission.

Before a video is generated, we check the prompt, including any details added to a preset, and block requests that clearly break these rules; a request blocked at this stage is not charged any credits. A Model Provider may also block a request under its own safety checks; that counts as a failed generation, and its credits are returned. We do not review every upload, but we may inspect, block or remove content and suspend or close accounts that we reasonably believe break these rules, without returning credits used in the violation. We may report illegal content and share related account information with law enforcement where the law requires it.

About AI-generated output

AI video models invent motion and detail that were not in your photo. Results depend on the model, the photo and the prompt, differ from one run to the next, and may contain inaccuracies or artifacts such as distorted faces, hands or text, flicker, or motion that does not follow your prompt. A video that completes but does not match what you hoped for is not a failed generation.

Output is not a record of real events. It must not be presented as genuine footage or relied on as evidence or to identify people. You are responsible for reviewing Output before you use or publish it, and for labeling it as AI-generated where the law or a platform's rules require that.

File storage

Videos made by guests and free accounts are deleted 7 days after they are created. Videos made while you have a Plan or Credit Pack are deleted 180 days after they are created. The Service is not a backup or archive: download anything you want to keep, because deleted files cannot be recovered.

Our intellectual property

The Service, including its software, design, text, graphics, logo and the ImageVideoAI name, belongs to us or our licensors and is protected by intellectual property laws. The model names mentioned on the Service belong to their owners. These Terms give you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service as intended, and they do not transfer any of our rights to you. If you send us feedback or suggestions, we may use them freely without paying you.

Copyright complaints

If you believe content created or shared through the Service infringes your copyright, email [email protected] with: your contact details; a description of the work; information that lets us find the content, such as a link; a statement that you believe in good faith the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you own or may act for the owner of the right. We will remove infringing content and close the accounts of repeat infringers where appropriate.

Third-party services and Model Providers

The Service relies on third parties, including Google for sign-in, Stripe for payments, Cloudflare for security and delivery, and the Model Providers for video generation. A model can be slow, change behavior or become unavailable because of its provider. We do not control those services and are not responsible for their content, policies or practices.

Suspension and termination

You can stop using the Service at any time and can ask us to delete your Account at [email protected]. We may suspend or close your Account, with or without notice, if you break these Terms, if the law requires it, or if your use puts the Service or other people at risk. If we close an Account in good standing for any other reason, we will refund the unused part of any Plan or Credit Pack.

When your Account is closed, your right to use the Service ends and your files and unused credits are deleted. Sections that by their nature should survive, including those on your content, intellectual property, disclaimers, limitation of liability, indemnity and governing law, continue to apply.

Disclaimer of warranties

To the maximum extent permitted by law, the Service and all Output are provided "AS IS" and "AS AVAILABLE", with all faults and without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the Service will meet your needs, produce any particular result, be available without interruption or be free of errors or harmful components. Some jurisdictions do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.

Limitation of liability

To the maximum extent permitted by law, ImageVideoAI and its affiliates, suppliers and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunities, arising out of or related to the Service or any Output, even if we were told such damages were possible.

Our total liability for all claims related to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or 100 US dollars. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud, or for death or personal injury caused by negligence.

Indemnification

To the extent the law allows, you agree to defend and indemnify ImageVideoAI and its affiliates against claims, damages, losses and expenses, including reasonable legal fees, arising from Your Content, your use of the Service or your breach of these Terms.

Governing law and disputes

If you have a concern about the Service, please contact [email protected] first. Most problems can be solved quickly this way, and you agree to try in good faith to settle a dispute informally for at least 30 days before starting formal proceedings. These Terms are governed by the laws of the place where the operator of ImageVideoAI is established, without regard to its conflict-of-law rules.

Consumers in the European Union and the United Kingdom

If you are a consumer living in the EU or the UK, you also benefit from the mandatory consumer protection laws of your country, and you may bring proceedings in the courts where you live. Because the Service is a digital service that starts when you use it, you agree when you buy that performance begins straight away, and once you use credits from a purchase you lose the statutory right of withdrawal for what you have used. Our Refund Policy still applies on top of that.

United States legal compliance

You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

General

  • Entire agreement: these Terms, the Privacy Policy and the Refund Policy are the whole agreement between you and us about the Service.
  • Severability: if a provision is found unenforceable, it is changed only as far as needed to make it enforceable, and the rest stays in effect.
  • No waiver: not enforcing a right does not mean we give it up.
  • Assignment: you may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
  • Force majeure: we are not responsible for delays or failures caused by events beyond our reasonable control, including outages at our hosting, payment or Model Providers.
  • Translations: if these Terms are translated, the English version prevails in case of conflict.

Changes to these Terms

We may update these Terms from time to time. We will post the new version here and change the date at the top. For material changes, we will give account holders at least 30 days' notice by email or on the Service before they take effect. If you keep using the Service after that, you accept the new Terms. If you do not, stop using the Service and cancel any Plan before the changes take effect.
